Standard Terms & Conditions – Financial Clarity Audit

Service: Financial Clarity Audit
1. Nature and Scope of Services
1.1 The Financial Clarity Audit provides business financial analysis and strategic insight for educational and decision-support purposes. It is not a tax, BAS, bookkeeping, or financial product service.
1.2 The service includes: onboarding conversation, Xero financial system review, financial analysis, one Financial Clarity Audit session, and two implementation support sessions.
1.3 The service focuses on interpreting your existing financial data (e.g. Xero) to identify trends, risks, and opportunities. It does not include preparation or lodgement of tax returns or BAS, bookkeeping clean-up, or independent audit/assurance services.
2. No Tax or BAS Services
2.1 VWC Group Pty Ltd trading as Vicky Wren Consulting is not a registered tax agent or BAS agent under the Tax Agent Services Act 2009.
2.2 Nothing in the Financial Clarity Audit is tax advice, BAS services, or financial product advice. Any references to tax or BAS are general in nature only and must not be relied upon as a substitute for advice from a registered tax agent, BAS agent, or licensed financial adviser.
2.3 You agree to obtain independent professional advice from your accountant, tax agent, BAS agent, or financial adviser before taking action based on the insights from the Financial Clarity Audit.
3. Your Responsibilities
3.1 You are responsible for providing true, complete, and accurate information and access to your accounting system (e.g. Xero) as reasonably required.
3.2 The quality of insights depends on the quality of your underlying data. The provider is not responsible for errors arising from incomplete, inaccurate, or unreconciled records.
4. Fees and Payment
4.1 The total fee for the Financial Clarity Audit is $3,000 AUD plus GST.
4.2 Unless otherwise stated on the booking page, a 50% deposit is payable at booking, with the balance due before the main Financial Clarity Audit session.
4.3 Fees are non-refundable once the Xero financial system review has commenced, except as required under Australian Consumer Law.
5. Cancellations and Rescheduling
5.1 You may reschedule sessions with at least 2 business days’ notice, subject to availability.
5.2 If you cancel the engagement after the review has commenced, no refund is payable, except as required under Australian Consumer Law.
6. Confidentiality
6.1 All financial and business information you provide will be treated as confidential and will not be disclosed to third parties unless required by law or with your consent.
7. Intellectual Property
7.1 All frameworks, methodologies, and materials provided during the Financial Clarity Audit remain the property of VWC Group Pty Ltd.
7.2 You may use the reports and insights for your internal business purposes only and must not reproduce or distribute them commercially without prior written consent.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, all implied warranties are excluded.
8.2 The provider’s total aggregate liability arising out of or in connection with the Financial Clarity Audit is limited to the total fees paid by you for the service.
8.3 The provider is not liable for any indirect or consequential loss, including loss of profit, revenue, or opportunity, arising from your use of or reliance on the information provided.
8.4 You acknowledge that all business, financial, and tax decisions are your responsibility and are made at your own risk.
9. Governing Law
9.1 These Terms & Conditions are governed by the laws of Western Australia, and the parties submit to the exclusive jurisdiction of the courts of Western Australia.
